We're glad you’ve chosen Rubicon. These terms are important because they describe what you can expect from us as you use the Rubicon workstation and what we expect from you in return.
By using our products or clicking I Agree, you’re entering into a legal contract with us. If you’re using Rubicon for a company, you’re also confirming that you have the authority to agree to these terms for that organization.
Service provider
Rubicon services are provided by, and you’re contracting with Rubicon, Inc.
Age requirements
Because our workstations are high-performance professional tools, you must be at least the age of majority in your jurisdiction to create an account and use the service.
What you can expect from us
We provide an integrated system designed to function as a responsive second skeleton for your body. This includes durable metal hardware, pneumatic suspension, and AI-driven analytics.
Providing and improving our services
We’re constantly working to improve your experience. This means we may push automatic software and firmware updates to your workstation. These updates are designed to maintain safety limiters, improve the efficiency of your support, and keep your system secure.
Our commitment to your privacy
We believe your movement is personal. We use encryption to protect your data and biometric data.
While we provide aggregated wellness reports to corporate customers to help them understand office-wide trends, we never share your individual movement patterns or specific posture habits with your employer. Your AI Spine Profile belongs to you personally and stays with you even if you move to a new company.
Hardware quality
Your workstation is built from high-strength, durable metal meant for professional use. We provide instructions and manuals to help you get the most out of your equipment and stay safe while doing so.
What we expect from you
We expect you to follow the guidelines below to ensure a safe and supportive environment for everyone.
Follow the safety rules
The Rubicon workstation is a sophisticated tool with mechanized parts that move in response to your weight. To stay safe, please follow these rules:
- Keep the area clear: Moving parts can cause serious injury or death. It is your responsibility to keep the workspace clear of obstructions, small children, and pets who could be harmed by the chair’s movement.
- Adult use only: This product is not intended for children or pets.
- Assembly and setup: If you assemble the workstation yourself, please follow the instructions carefully. Rubicon isn't responsible for injuries or damage caused by incorrect assembly.
- Usage limits: This workstation has a static load limit of 300 lbs. Exceeding this limit could lead to structural failure and will void your warranty.
- Intended use: Use the workstation only for seated professional work. Using it as a ladder or for moving heavy objects is dangerous and voids your support.
Respect our technology
The ideas and technology inside Rubicon are proprietary. We expect you to respect our intellectual property by following these restrictions:
- No tampering: Reverse engineering, tampering, or modifying the hardware or software is a serious violation of this contract.
- Official repairs only: To ensure quality and safety, all repairs must be done by Rubicon or a certified provider. Third-party repairs will immediately void your warranty.
- No unauthorized access: You may not try to access our source code or alter the pneumatic suspension system.
Your content and data
By using the workstation, you provide your express written consent for Rubicon to collect and process your biometric identifiers as described in our Privacy Policy. This consent is designed to comply with laws like the Illinois Biometric Information Privacy Act (BIPA) and California’s CCPA/CPRA as well as international standards like GDPR.
In case of problems or disagreements
Both the law and these terms give you the right to a certain quality of service and ways to fix problems if things go wrong.
Health and medical disclaimer
Rubicon is not a medical device, nor is it designed to replace one.
Our products are for general wellness only. You should consult your doctor before use if you have a history of back or neck pain. If you feel any discomfort, stop using the chair immediately and seek medical help. Rubicon does not provide medical advice or treatment.
Warranty and disclaimers
We provide our hardware and software as is and as available.
This means we don't make specific promises about the digital features' continuous availability or that the workstation will cure any specific health issue.
Limitation of liability
To the extent allowed by law, Rubicon’s total liability for any claims related to these terms is limited to the total amount you paid Rubicon in the 12 months before the claim.
Rubicon isn't responsible for indirect problems like lost profits or data. You use the Rubicon system at your own risk.
Indemnity
If you’re a business user, you will defend and protect Rubicon and its officers, directors, associates, and affiliates from any legal costs or claims arising from your breach of these terms, your unauthorized modifications to the hardware, or your incorrect assembly of the unit.
Settlement of disputes and governing law
Delaware law will govern all disputes arising out of these terms. If we have a disagreement, we’ll first try to resolve it by talking for at least 30 days.
If we can’t resolve it informally, the dispute will be settled through binding arbitration with the American Arbitration Association in Dover, Delaware.
You agree to resolve disputes on an individual basis and waive your right to participate in any class action lawsuit.
About these terms
If a court finds that a particular term isn't valid, the rest of the terms will remain in place. If you don't follow these terms and we don't take action right away, that doesn't mean we’re giving up any rights we may have.
These terms describe the entire relationship between you and Rubicon. The sections on Intellectual Property, Liability, Indemnity, and Disputes will continue to apply even if you stop using the service.
